Herbert Kier appeals his conviction of first degree robbery and first degree assault. He argues that the trial court erred when it denied his motion for new trial, when it considered ex parte evidence in determining the new trial motion, and when it failed to set forth his prior juvenile convictions that form the basis of his offender score. The trial court did not violate due process or the Code of Judicial Conduct in determining the new trial motion. The trial court erred when it failed to fully resolve the questions of fact raised in the new trial motion and when it failed to properly reflect Kiers criminal history in the offender score. We remand for a fact-finding hearing and, in the event the trial court denies the motion for new trial, for resentencing.
